Pool Captains App Terms of Service and End User License Agreement

These Terms of Service and End User License Agreement (the “Terms”) govern access to and use of the Pool Captains application (the “App”), which is provided by Pool Captains FL Holdings, LLC (“Pool Captains,” “we,” “us,” or “our”). The App is identified as “Pool Captains” in Intuit-facing app listings and connection screens. Internally, the App operates through Deckhand, Pool Captains’ internal operations software.
The App is a workplace tool for Pool Captains employees and other workers we authorize. It is not a consumer product and is not offered to pool-service customers or the general public. By accessing or using the App, you agree to these Terms.
1. Eligibility and internal use
You may use the App only if Pool Captains has authorized you, issued or approved your login, and kept your access active. You may use it only for legitimate Pool Captains business. If your employment or authorization ends, your right to use the App ends immediately.
2. License and ownership
Subject to these Terms, Pool Captains grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the App for Pool Captains business while your account remains active.
Pool Captains owns the App, including its software, design, and content, except for third-party materials and services. These Terms do not transfer ownership of the App or any related intellectual property to you.
3. QuickBooks connection
The App may connect to Pool Captains' QuickBooks company account so users with the required internal permission can view accounting data in an internal dashboard. This connection is read-only. The App never writes to QuickBooks.
The company owner controls the QuickBooks connection. Accounting data is behind a dedicated permission that the owner holds by default. Instructions for ending the connection are available at https://poolcaptains.com/quickbooks-disconnect.
4. Acceptable use and account security
You agree to:
- keep your login private and use two-factor authentication as required;
- use the App only for authorized Pool Captains work;
- access accounting information only if you have the required permission;
- not share customer, employee, operational, or accounting information outside Pool Captains unless authorized;
- not interfere with the App, bypass access controls, introduce malicious code, or attempt unauthorized access; and
- not copy, modify, reverse engineer, or create derivative works from the App except to the limited extent applicable law does not allow that restriction.
Report suspected misuse or unauthorized access promptly to team@poolcaptains.com.
5. Privacy
Our Pool Captains App Privacy Policy explains how Pool Captains handles information through the App, including QuickBooks data and connection tokens. It is available at https://poolcaptains.com/privacy and is incorporated into these Terms.
6. Third-party services
QuickBooks is provided by Intuit and is subject to Intuit's applicable terms and policies. Pool Captains does not control the availability or operation of QuickBooks. A change, interruption, or termination of QuickBooks may affect the App's QuickBooks features.
7. Changes, availability, and termination
We may change, suspend, or discontinue the App or any feature, including the QuickBooks connection, at any time. We do not promise uninterrupted or error-free access. We may suspend or terminate your access at any time, including when your employment or authorization ends or if you violate these Terms.
8. Disclaimers
Accounting information shown in the internal dashboard comes from QuickBooks and may be delayed, incomplete, or affected by connection issues. The dashboard is not a substitute for QuickBooks as the system of record or for professional accounting, tax, or legal advice.
The App is provided "as is" and "as available." To the fullest extent permitted by law, Pool Captains disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Pool Captains and its managers, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or lost data, arising out of or related to these Terms or use of the App. These limits do not apply to liability that cannot lawfully be excluded or limited.
10. Governing law and venue
Florida law governs these Terms, without regard to conflict-of-law rules. Any dispute arising from these Terms or the App will be brought in the state courts located in Walton County, Florida, or, if federal jurisdiction exists, in the United States District Court for the Northern District of Florida, Pensacola Division.
We may update these Terms by posting a revised version at this URL and changing the effective date. Continued use after the revised Terms take effect means you accept them.
11. General terms
These Terms and the Pool Captains App Privacy Policy are the entire agreement about authorized use of the App and replace prior discussions on that subject. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; Pool Captains may assign them as part of a reorganization, merger, or transfer of the App or related business. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, governing law, and these general terms.
